OPINION
RUSSELL, Judge.
James David Carter, the plaintiff-in-error, was jointly indicted with Gene Johnson and Bobby Ray Wilder, and charged with third degree burglary upon the premises of Gibson’s Discount Center. Carter was also indicted alone in a three count indictment charging first degree burglary, grand larceny, and receiving and concealing stolen property; these charges arising out of the alleged theft of a television set from the residence of Parley Young. Both of these cases against Carter were tried before the same jury and are now before us for determination upon one record. Wilder…
