This panel was convened pursuant to Administrative Order No. 1996-4 to resolve a conflict between the opinion previously issued in this case1 *664and the opinion in People v Lino (After Remand), 213 Mich App 89; 539 NW2d 545 (1995).

Defendant was convicted by a jury of assault with intent to rob while armed, MCL 750.89; MSA 28.284, and assault with intent to do great bodily harm less than murder, MCL 750.84; MSA 28.279.
