MEMORANDUM OPINION

WARD, District Judge.

This action came on for hearing by the Court on December 20, 1974, on the plaintiff’s motion for partial summary judgment and declaratory relief. Counsel for the plaintiff and defendant were present, as well as counsel from the Attorney General’s Office of the State of North Carolina, defendant-intervenor. The plaintiff claims damages resulting from the sale of his property pursuant to the sale provisions of North Carolina’s possessory lien statute, N.C.G.S. § 44A-4.
