RSA 265:89-a provides that a defendant in a civil action arising from an accident that resulted in his conviction for driving while intoxicated for a second or subsequent time within seven years is liable for double damages. This is an interlocutory appeal from a Superior Court (Pappagianis, J.) ruling that RSA 265:89-a applies to the plaintiffs’ action despite the fact that RSA 265:89-a did not become effective until nearly two years after the accident and the defendant’s accompanying conviction for driving while intoxicated (DWI).
