In an action to recover damages for personal injuries, etc., the *717plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Orange County (McGuirk, J.), entered May 22, 2009, as granted the defendant’s motion for summary judgment dismissing the complaint.

Ordered that the order is affirmed insofar as appealed from, with costs.

The infant plaintiff was injured while standing in the driveway of his home approximately 10 to 15 feet behind a moving van, which was owned by the defendant and rented to the infant plaintiffs grandmother on the day of the accident. As…
