Jose Daba was convicted by a jury in the Superior Court for King County of the crime of second degree murder. From entry of the judgment and sentence, predicated upon the jury’s verdict, he has appealed.

At approximately 1 a.m. on April 30, 1967, Michael B. Sauntry and two companions, Robert E. Youngs and Bradford J. Williams, after consuming a number of drinks, left a bachelor party held at the Olympic Hotel in Seattle.
