F. S. Koyster Guano Company sued T. J. Williams on two promissory notes which contained bills of sale to secure debt. The defendant filed a plea of non est factum at the first term. At the trial term he amended his original plea by alleging that the notes sued on were void because of material alterations, consisting in the addition of a tenant’s name on each note as comaker, and the addition of the signature of an official witness. The trial, in which the only issue submitted to the jury was the question as to whether the defendant executed the notes, resulted in a verdict for the plaintiff.…
