Defendant, A. L. Coppage, was charged in the district court of Tulsa county,, Olda., with the crime of sodomy. His case was transferred on change of venue to- Pawnee county, where he was tried, convicted, and sentenced to> serve a term of ten years in the State Penitentiary at McAlester. From this judgment and sentence he has appealed.

Defendant has presented and argued in his brief eight-assignments of error. These assignments will be considered under three heads, as several of them are so similar that they may be considered together.
