Plaintiffs-appellees brought this action for injunctive and declaratory relief, alleging that appellant’s “set-aside” program for public contract awards, enacted as “Chapter 12%” of the New Haven Municipal Code, violated their right to equal protection of the laws guaranteed by the Fourteenth Amendment and 42 U.S.C. § 1983. 1 The district court entered summary judgment in plaintiffs’ favor, declaring that the ordinance violated the Equal Protection Clause. 791 F.Supp. 941 (D.Conn.1992).
