The plaintiff in error hereinafter called defendant, was convicted in the district court of Blaine county of the crime of forgery in the second degree and his punishment fixed by the jury at one year in the state penitentiary.
The defendant was indebted to-the American State Bank of Geary in the sum of $5,000, and the record discloses that at one time he was indebted to the bank in the sum of approximately $15,000; that the bank was not able to carry such a large loan against any one man, and the defendant was required to make arrangements to care for a portion of the amount, and in so doing…
