This action arises out of separate patent infringement suits filed by Dr. Jerre Freeman against CooperVision, Inc. (“CooperVision”) and Minnesota Mining and Manufacturing Company (“3M”) for infringement of Freeman’s patent relating to intraocular lenses. The suits were consolidated for the purposes of discovery and trial on the issues of validity, scope of the claims, infringement, and enforceability because of common issues of law and fact.
