[1.] At the trial of this cause the following order was passed by the Court: “ It appearing to the Court that Oswell E. Cash-in, plaintiff on the record, was administrator in virtue of his office, as Clerk of the Superior Court of Richmond county, that said Oswell E’s term of service has expired and that Benjamin F. Hall is Clerk and ex-officio administrator of Gazaway Beale, be, and is hereby made a party plaintiff as such administrator, in lieu of said Oswell E.
