On the 5th day of February, 1912, Herman A. Flechs and wife executed and delivered to Joseph B. Swan, one of the plaintiffs herein an oil and gas lease for a term of five years- upon 40 acres of land in Okmulgee county, said lease providing for the payment to the lessors of one-eighth of all the oil produced and saved from the premises, delivered in tanks or -pipe lines, to. the lessors’ .credit, and $150 each year for the production of -each gas well while gas therefrom was used off the premises.
