The appellant, as the administrator of the estate of one Wiliam M. Cobbum, deceased, sued the appellee to recover damages sustained by the widow and children of the deceased, resulting to them on account of his death, which is alleged to have been caused by the negligence of the appellee, and ivithout any fault or negligence on the part of the deceased. The issues joined were tried by a jury. At the close of the plaintiffs evidence the court instructed the jury to return a verdict for the defendant, which they *457accordingly did.
