*691Appeal by the defendant from a judgment of the County Court, Dutchess County (Dolan, J.), rendered December 8, 2005, convicting him of criminal sexual act in the first degree, upon his plea of guilty, and imposing sentence.

Ordered that the judgment is affirmed.

While the defendant’s challenge to the voluntariness of his plea survives his appeal waiver (see People v Seaberg, 74 NY2d 1, 10 [1989]), it is without merit.
