WALKER, Circuit Judge:

The United States of America appeals from a judgment of the United States District Court for the Eastern District of New York (Leonard D. Wexler, Judge) affirming *556the decision of the bankruptcy court which held that priority claims under 11 U.S.C. § 726(a)(1) lose their priority status if they are tardily filed. We reverse the judgment of the district court and remand for further proceedings.
