The defendant, Springer Lake Trout Club, is a nonprofit corporation owning land on Springer Lake near Olympia. There is no access to the club’s land except via a private road on the adjacent land owned by the defendant Pendleton Miller. Miller permitted the members of the club to use the access road on the condition that the club keep the road properly gated. The gate used was a steel cable stretched across the road between two trees.
