BENTON, Circuit Judge.

Alexander Louis Perez pled guilty to possession with intent to distribute methamphetamine, in violation of 21 U.S.C. §§ 841(a)(1), (b)(1)(B), and possession of a firearm during a drug trafficking crime, in violation of 18 U.S.C. § 924(c)(1)(A). The district court 1 sentenced him to 157 months’ imprisonment. Perez appeals, arguing that the district court erred in denying his request for an evidentiary hearing on substantial assistance, and that Federal Rule of Criminal Procedure 35(b), 18 U.S.C. § 3553(e), and U.S.S.G. § 5K1.1 are unconstitutional.
