MEMORANDUM AND ORDER

ATLAS, District Judge.

Pending before the Court is Defendant’s Motion for Summary Judgment [Doc. # 39]. Having considered the motion, the parties’ responses, and the appropriate legal authori ties, the Court finds that this motion is without merit and should be DENIED.

I. Factual Background
