TORRUELLA, Circuit Judge.

A grand jury returned a five-count indictment alleging various firearm related charges against defendant/appellant Frederick Hardy and his co-defendant Raymond Moreno, Jr. A trial was held and the jury found both defendants guilty on all counts. Moreno challenged his conviction in a separate appeal. United States v. Moreno, 991 F.2d 943 (1st Cir.) (Torruella, J., dissenting), cert. denied, — U.S.-, 114 S.Ct. 457, 126 L.Ed.2d 389 (1993).
