This action was brought to recover the amount of a check drawn by appellant on the Bannock National Bank, of Pocatello, Idaho, in favor of respondents, which, by reason of the bank’s failure, was not paid.

The case was tried before the court without a jury on the following facts stipulated by the parties by their respective counsel: That the plaintiffs are now and at all the times herein mentioned have been copartners doing business under the firm name and style of Bistline Lumber Company at Pocatello, Idaho; that on May, 11, 1921, at 1 o’clock P.
