This was an action on a promissory note by the Fidelity Savings State Bank of Topeka against Harry E. Grimes, the maker thereof. The defendant prevailed, and plaintiff appeals.

The note bore the signature of the defendant, Harry E. Grimes, *56who was engaged in the motor transport business. The payee was the Industrial Mutual Liability Insurance Company.
