OPINION
{¶ 1} Defendant-appellant Mark Turnbow appeals from the November 7, 2005 Judgment Entry of the Stark County Court of Common Pleas overruling his Petition for Post-Conviction Relief.
STATEMENT OF THE FACTS AND CASE
{¶ 2} On September 7, 2004, the Stark County Grand Jury indicted appellant on three counts of felonious assault in violation of R.C.2903.11(A)(2), felonies of the first degree, and one count of failure to comply with an order or signal of a police officer in violation of R.C.2921.331(B)(C)(5)(a)(ii), a felony of the third degree.
