MEMORANDUM **

The facts and procedural posture of this case are known to the parties, and we do not repeat them here. Appellant Robert Rizzo appeals the district court’s order granting Defendant’s Motion for Summary Judgment and denying Plaintiffs Motion for Partial Summary Judgment, as well as the district court’s denial of his Motion for Reconsideration of that order. We have jurisdiction pursuant to 28 U.S.C. § 1291, and we affirm in part and remand in part.
