Haymond, President:

The defendant, William M. Lewis, a practicing physician and surgeon, of Huntington, Cabell County, West Virginia, was jointly indicted with Julia Darling, a nurse, at the June, 1948, term of the Common Pleas Court of that county, for the murder of one Mildred Ferguson. He was tried separately upon the indictment, to which he entered his plea of not guilty and, at that term of court, was found guilty of the crime of murder of the second degree by the verdict of a jury on July 9, 1948.
