Greene, J. :

This was an action on a promissory note. The cause was tried without a jury, and the court made special findings of fact and conclusions of law. It appears that the note in question was executed at Lyons, Kan'., and payable at Marshalltown, Iowa; that the words “with exchange” were printed in the note ; that before it was executed the maker erased these words, but after its delivery the payee, without the knowledge or consent of the maker, rewrote them.
