Memorandum:
Petitioner commenced this CPLR article 78 proceeding seeking to annul the determination of respondents, his former employers, denying his application for disability pension benefits, and in appeal No. 1 respondents appeal from an order that, inter alia, granted in part petitioner’s motion pursuant to CPLR 5015 (a) (3) seeking to vacate the judgment dismissing his amended petition.
