On July 23, 1999, Plaintiffs filed a five-count complaint against Defendants Manufactures Des Montres Jaguar, S.A. (“MMJ”), Festina, U.S.A., Inc. (“Festina”), and Universal Watch and Jewelry Company (“Universal”), asserting claims of unfair competition and dilution under the Lanham Act (Count I), trademark infringement under the Lanham Act (Count II), cancellation of trademark number 1,219,068 (Count III), common law unfair competition (Count IV), and common law trademark infringement (Count V).
