OPINION

By THE COURT

This action originated in the Municipal Court of Columbus and was appealed to the Common Pleas Court oi Franklin County. In the Common Pleas Court the plaintiff sought to recover damages occasioned by alleged negligent acts of the defendant in the operation of an automobile at the intersection of Fisher Road and Hague Avenue in Franklin County on the 25th of September, 1935. The defendant filed a general denial and also a cross-petition for damages to its automobile. The court dismissed the cross-petition and the jury found for the plaintiff in the sum of $300.00.
