DUNKLIN J.

D. C. Cave shipped 83 head of cattle from the town of Snyder to the town of Hamlin. They were transported from Snyder to Roscoe over the Roscoe, Snyder & Pacific Railway, thence over the Texas & Pacific Railway to Sweetwater, and from Sweetwater to the town of Hamlin, their destination, over the Kansas City, Mexico & Orient Railway. Cave instituted this suit to recover damages for alleged injuries to the cattle sustained during such shipment; each and all of said railway companies being made defendants, with the exception that Hovey & Mertz were sued as receivers of the Kansas City,…
