This cause was submitted to the court below upon an agreed statement of facts as authorized by section 7930, G. S. 1913. Judgment was ordered and entered for defendant and plaintiff appealed.
*315The facts agreed upon, as disclosed by the stipulation of the parties, are substantially as follows: On June 14, 1913, Martha A. Miller, widow, and her son, were the owners of certain real property fronting on Eobert street in the city of St. Paul.
