MEMORANDUM OPINION AND ORDER

Pursuant to 42 U.S.C. § 1983, plaintiff Aaron H. Rosenthal (“Rosenthal”) brings the above-captioned action claiming that defendants Board of Trustees of the New York City Police Pension Fund, Article II (“Board of Trustees”) and Police Commissioner William Bratton1 (collectively “defendants”) deprived him of certain retirement benefits in violation of his constitutional right to due process.
