MEMORANDUM OPINION
GLEN M. WILLIAMS, District Judge.
Clinchfield Coal Company (hereinafter, Clinchfield) has filed this complaint against Local Union No. 1452, United Mine Workers of America. and District 28, United Mine Workers of America (hereinafter, Union) seeking to vacate the award of arbitrator Robert J. Abies dated October 30, 1982 which became final and binding on December 15, 1982. This court has jurisdiction pursuant to Section 301(a), 29 U.S.C. § 185(a).
