CASTLE, Senior Circuit Judge.

The defendant-appellant, Bennie Bradley, prosecutes this appeal from the judgment order of conviction and sentence entered following a jury trial on an in dictment charging him and certain named co-defendants 1 with conspiracy 2 to unlawfully transfer a quantity of marihuana not in pursuance of a written order form issued by the Secretary of the Treasury, in violation of 26 U.S.C. § 4742(a). He was sentenced to the custody of the Attorney General for a period of three years.
