MEMORANDUM ORDER

FLANNERY, District Judge.

This matter comes before the court on defendants’ Motion to Dismiss the Complaint or in the Alternative For Summary Judgment. For the reasons set forth below, defendants’ Motion is denied.

I. Background

This action was brought by plaintiff, an officer of the Metropolitan Police Department of the District of Columbia (“MPD”), based upon the MPD’s refusal to promote him to the rank of sergeant.
