delivered the opinion of the court.

This is a mandamus proceeding instituted by the People on relation of H. M. Boy against the Board of Supervisors of Knox County, seeking to compel said board to restore the said Boy to the office of county superintendent of highways.

Boy was duly appointed to that office on June 9,1924, and entered upon the discharge of his duties.
