Boyed Teter and George Teter were the ¡plaintiffs in the court below, and are the appellees here. The appellants were the defendants below. The original com.plaint was filed on the 3d day of August, 1870, and was .against Joseph A. Yancy and James L. Yancy. The action was based upon a note alleged to have been executed by the defendants, payable to the appellees for the sum of one thousand one hundred and fifty dollars, and upon an alleged balance of fifty-five dollars due upon an account.
