This is an appeal filed pursuant to Rule 8C of the District/Municipal Courts Rules for Appellate Division Appeals to proceed on the record on issues raised solely by the pleadings. In this case, the plaintiff-appellant, Noreastco Door & Millwork, Inc. (hereinafter “Noreastco”) appeals from the allowance of the Defendant’s Motion for Summary Judgment and the denial of the Plaintiff’s Motion for Partial Summary Judgment, both based upon a finding that there was not a written contract within the meaning of the Mechanic’s Lien statute, G.L.c. 254, Section 4.
