This was an action to recover damages of the defendant for an interference with, or obstruction of, the plaintiff’s business as a hotel and restaurant keeper, alleged to have been caused by the erection and maintenance of a fence upon a strip of land, or alleyway, lying between the hotel premises and the rail road, depot and property. The hotel building stands on the southwest corner of Michigan and Exchange streets in the city of Buffalo, and adjacent thereto, upon the south, are the defendant’s-yards and depot properties.
