On January 20, 1994, the Court heard argument on the exceptions to the Magistrate Judge’s Report filed by defendant Eastern Auto Distributors, Inc. Prior to the oral argument, the Court had reviewed de novo the complete file in this ease, including the pleadings, Magistrate Judge’s Report and Recommendation, the briefs and exceptions to the report.
