MEMORANDUM AND ORDER

GLEESON, District Judge.

Plaintiff Anthony Carollo seeks a declaration that he is exempt from the statutory bar on his serving as a union official because of a prior criminal conviction or, in the alternative, a preliminary injunction to that effect while the Court considers .his application. For the reasons discussed below, the request for a declaration is held in abeyance pending a hearing on the subject and the request for a preliminary injunction is denied.
