This matter comes before the Court on separate motions to dismiss the above-captioned adversary proceeding filed by the Defendants, Rosenberg & Associates, LLC (“Rosenberg”) and EMC Mortgage Corporation (“EMC”). Allen T. Harland and Kristian L.
