— This is an action at law in eight counts, brought by the city of Corning, Iowa, against the Iowa-Nebraska Light & Power Company and the United States Fidelity & Guaranty Company, Baltimore, Maryland, asking damages on three injunction bonds given by the defendants in a prior suit brought by the defendant Iowa-Nebraska Light & Power Company to enjoin the city of Coming from the erection of a municipal light and power plant, in which suit decree was entered for defendant. Jury waived, and cause tried to the court as an action at law.
