Plaintiffs brought suit in the circuit court of Cook county to restrain the city of Chicago and its officers from enforcing the provisions of the city’s zoning ordinance in so far as it prohibits them from using their property as a two-family dwelling. They charged that, as applied to their property, the ordinance violates the State and Federal constitutional guaranties of due process, and is confiscatory.
