KRUEGER, Judge.

Appellant was convicted of the offense of robbery by the use of firearms and his punishment was assessed at confinement in the state penitentiary for a term of fifty years.

The testimony adduced upon the trial, briefly stated, shows that on the night of December 26,1944, appellant and one, Joseph Allen Owens, by the use of a pistol, robbed Joe Whitlock, a cab driver, of approximately eight dollars in money.
