Thomas Richard Walker appeals from a final judgment entered in the District Court 1 for the District of Minnesota, denying his motion to dismiss his indictment for conspiracy to distribute cocaine in violation of 21 U.S.C. § 846 (1988). After appellant entered into a plea agreement, the district court sentenced him to a term of three years incarceration and a special assessment of $50.00.
