In a trial by jury before one of the judges of the recorder’s court of Detroit defendant was convicted of assault and battery. The case has been brought here on exceptions before sentence. Two questions are presented:

1. That the court erred in overruling a challenge to *634the array. The grounds of the challenge are fully stated and the ruling of the court sustained in People v. McNutt, ante, 620.

2. That the court erred in requiring defendant to submit to a trial by jury, over his objection, no jury having been demanded by him. . The offense charged was cognizable by a justice of the peace (3…
