HOLTZOFF, District Judge.

The District of Columbia, between 1948 and 1950, constructed a vehicular underpass under Connecticut Avenue, one of the main thoroughfares in the city of Washington, at a point known as Dupont Circle, where Connecticut Avenue intersects a number of other streets. The purpose of the tunnel was to expedite the movement of vehicular traffic and to protect pedestrians having occasion to cross one of the streets at that intersection.
