At the August term, 1880, of the Hustings court of the town of Danville, James Thomas Dejarnette was indicted for the murder of his sister, Mollie Dejarnette. He was tried at the October term of the court and found guilty of murder in the first degree. In the progress of the case the prisoner took twenty bills of exception to rulings of the court. The last was to the refusal of the court to grant a new trial, in which all the evidence is set out.

Tins case comes before us upon a writ of error to a judgment of the corporation court of Danville, sentencing the accused to be hanged, numerous errors are assigned in the petition for an appeal, which will be considered in the order in which they are presented.

The first bill of exceptions states that upon the calling of the venire, C. H. Barksdale, one of the veniremen, being asked by the court whether or not he had formed or expressed an opinion as to the guilt or innocence of the prisoner, said that at first he had formed a hypothetical opinion, but had afterwards heard other evidence…
