OPINION

LUONGO, District Judge.

Plaintiff, James L. Kahermanes, instituted this suit seeking compensatory and punitive damages from the defendants for conspiring to search and to arrest him and to defame him. In his complaint, plaintiff alleged that on April 14, 1972, he was one of several defendants who were on trial at the Montgomery County Courthouse in Norristown, Pennsylvania, on charges of assault and battery; that Steven Márchese, Jr., one of the complaining witnesses, and his father, Steven Márchese, Sr., told Deputy Sheriff Sergeant Fair that the plaintiff was carrying a concealed gun…
